INFORMATION NOTE ON PROCESSING OF PERSONAL DATA & DECLARATION OF EXPLICIT CONSENT

As Swissdent Bodrum, we may need to collect your personal information and health data within the scope of the services we will provide to you, and we may need to process them to the extent required by the services to be provided.

Your health data that need to be recorded so that we can provide you with health services are defined as sensitive data under applicable law. Personal Data Protection Law No. 6698 Art. 6 Par. 2 requires us to obtain your explicit consent before processing your personal data.

1. Definitions
Personal Data : any information relating to an identified or identifiable natural person.

Processing of Personal Data : all sorts of transactions performed on personal data such as the collection, recording, storage, retention, alteration, rearrangement, disclosure, transfer, takeover, making accessible, classification or prohibiting the use of personal data through either fully automated / semi-automated or non-automated means provided that the latter are part of a data recording system.

Data Controller : A natural or legal person (in this case, Swissdent Bodrum) who determines the purposes and means of personal data processing and is responsible for establishing and managing a data recording system.
Data Processor : A natural or legal person who processes personal data on behalf and with the authorization of the data controller.

2. Processed Personal Data

• Identity information: Your name, surname, Turkish ID number, passport number or Turkish temporary ID number, gender, place and date of birth, marital status and other identifying information that allows us to identify you, as well as information obtained from the ID card you provide, and if you contact us through your social media account, the names you use and share with us on the relevant platforms.
• Contact details: Your address, fixed or mobile phone number, email address and other communication data as well as your social media account information such as Instagram etc.
• Digital data: All conversation, message and video recordings such as records of your oral and written communications with our clinic, video recordings made with the surveillance cameras in our clinic, and medical imaging records.
• Financial data: Your financial data such as your bank account number, IBAN number, credit card information and billing information.
• Health information: Records of all kinds of medical procedures performed in our clinic during medical diagnosis and treatment, including without limitation your laboratory results, test results, examination data, appointment information, prescription information, medical imaging information, previous health data, treatment history, all kinds of health and sexual life data obtained during diagnosis and/or treatment.
• Other: Your private health insurance data and Social Security Institution data for the financing and planning of your health services, navigation information obtained during your use of our website and mobile application, IP address, browser information and medical documents, surveys, form information and location data shared of your own accord.
  Along with the information and data listed above, we may also need to collect other personal data provided directly by you and process them to the extent necessary for the purposes listed below in order to conduct diagnosis and treatment, make the necessary planning, communicate with you, provide information on issues that may be of interest to you, keep you posted about special offers and novelties, fulfill our contractual and legal obligations, and process those data to the extent required for the purposes set out below.

3. Purpose and Legal Grounds for Personal Data Processing

Please be informed that we may process your personal data/information listed above and your sensitive personal data for the following purposes:

• Protecting public health, performing preventive medicine, medical diagnosis, treatment and care services,
• Sharing the requested information with the Ministry of Health and other public institutions and organizations as per applicable legislation,
• Fulfilling legal and regulatory requirements,
• Sharing information about your health condition with another physician for an exchange of opinion,
• Disclosure of information by the patient services, finance and marketing departments in connection with the coverage of health services, examination, diagnosis and treatment costs,
• Informing you about your appointment through our Secretariat and Digital Media,
• Confirmation of your identity by our Health Staff and Secretariat department,
• Analysis of information by the clinic management to improve our health services,
• Performance of risk management and quality improvement activities by the clinic management for enhanced quality, patient experience, and information systems,
• Billing of services, responding to any questions and complaints that you may have concerning the health services that have been or will be provided to you,
• Taking of all necessary technical and administrative measures by the clinic management to ensure data security in all systems and applications, designing and communicating special contents, tangible and intangible benefits on the web and through mobile channels, measuring, increasing and surveying patient satisfaction.
  Sensitive personal data can be processed without the data subject’s explicit consent only by persons bound to confidentiality or by authorized public authorities and only if and to the extent it is required for protecting public health, offering preventive medicine, medical diagnosis, treatment, and medical care services, and planning and managing health services including their insurance coverage.

4. Data Security and Data Transfer

• Ministry of Health, sub-units affiliated to the ministry, and family medicine centers,
• Social Security Institution,
• Turkish National Police and other law enforcement agencies,
• Directorate General of Civil Registration and Citizenship Affairs,
• Turkish Pharmacists’ Association,
• Judicial authorities,
• Doctors, clinics, laboratories, medical centers, ambulances, medical equipment and health service providers in Turkey and abroad, with which Swissdent Bodrum cooperates for medical diagnosis and treatment, and any other health institution to which you may be referred or to which you may consult yourself,
• Legal representatives you have authorized,
• Third parties you consult, including lawyers, tax consultants and auditors you work with,
• Regulatory and supervisory bodies and official authorities.

Method and Legal Grounds for Collecting Personal Data
Your personal data are collected and processed in all kinds of verbal, written, visual or electronic media in order for Swissdent Bodrum to pursue the purposes set out hereinabove, to conduct all our business activities in line with legal requirements, and to fulfill our contractual and legal obligations fully and properly.

I have read and understood the above information and hereby give my explicit consent to Swissdent Bodrum to collect my personal data in line with the following legal grounds, as explained in full detail hereinabove:

• Personal Data Protection Law No. 6698,
• Fundamental Law on Healthcare Services (Law No. 3359),
• Decree-Law No. 663 on the Organization and Duties of the Ministry of Health and affiliated institutions,
• Regulation on Processing and Protecting the Privacy of Personal Health Data,
• Regulations of the Ministry of Health and other provisions under applicable law.
• Furthermore, I know that as provided for in the Personal Data Protection Law No. 6698 Art. 6 Par. 3, my sensitive personal data can be processed by persons bound to confidentiality or by authorized public authorities without my explicit consent if and to the extent it is required for protecting public health, offering preventive medicine, medical diagnosis, treatment, and medical care services, and planning and managing health services including their insurance coverage.

5. Your Rights under the PDP Law

I have been informed that I have the right to:

• learn whether or not my personal data are being processed,
• if yes, request information about the processing of my personal data,
• have access to and request to see my personal data,
• learn the purpose for processing my personal data and whether they are used for intended purposes,
• get information about the third parties to whom my personal data are transferred in or outside the country,
• request rectification of data that have been processed incompletely or inaccurately,
• request deletion or destruction of my personal data,
• if my personal data have been processed incompletely or inaccurately and rectified as per my request, or they are deleted or destructed as per my request, request that any such action is notified to the third parties to whom my personal data have been transferred, and
• object to the processing, exclusively by automated means, of my personal data that may have unfavorable consequences on my behalf
• request compensation for any damage that I may suffer due to the unlawful processing of my personal data.

4. Declaration of Consent

I hereby declare that I have read and understood the Information Note on Processing of Personal Data issued by Swissdent Bodrum, and that I have been informed in full detail about the purposes which my personal data can be processed for, the institutions, bodies, companies and medical professionals which my personal data can be transferred to, the methods and legal grounds for data collection, my rights regarding the protection of my personal data as well as issues on data security and my right of opposition. Also, I HEREBY GIVE MY EXPLICIT CONSENT that my personal data and sensitive personal data can be retained, processed and transferred in line with the requirements set out in the Information Note on Processing of Personal Data if and to the extent this is necessary for the fulfilment of contractual or legal obligations, or in order for Swissdent Bodrum to fulfil their legal obligations, for protecting public health, performing preventive medicine, medical diagnosis, treatment and care services, or planning and managing health services including their insurance coverage.
